Standard Terms and Conditions of Engagement
Services will be specified in an agreed letter of engagement.
Services are charged either on a time or a project basis. Agreement as to the cost of services is determined in advance and the fees for those services will be set out in the letter of engagement. If the letter of engagement specifies a fixed fee, that fee will be charged for the work that is specified. Unspecified services will be charged on an hourly rate basis unless otherwise agreed, with advice being given as soon as reasonably practicable if unspecified services arise. Invoices will be issued monthly and will be due for payment by the 20th of the following month.
Costs incurred for travelling, accommodation and other disbursements will be agreed beforehand. If, as a consequence of the provision of services or products, sales tax, customs duty or other taxes, duties, tariffs, levies or surcharges imposed by any governmental or statutory authority subsequently arise, then those extra costs will become chargeable.
A client may terminate at any time and without notice any services provided on a time and materials basis. Services will be charged only up to the time of termination. Under any other circumstances, termination shall be subject to mutual agreement. In the event of termination a fair price will be charged for work already done.
All services and products are provided under the laws of New Zealand.
There is a professional responsibility to provide services and products which as far as is reasonably practical meet the terms of reference, specifications and standards that have been agreed. Problems will be remedied on a time and materials basis.
All information received and output produced is treated in the strictest confidence. All employees are required to sign a confidentiality undertaking related to their employment.
Procedures exist to identify and deal with conflicts of interest. If a conflict of interest arises, advice of the conflict will be provided immediately.
The service agreement includes all correspondence and contracts.
